Civil Law

Our activity includes consultancy and representation to clients in courts or before the public or private institutions in the following sectors of the civil law:

commercial litigation (including litigation regarding the execution of contracts awarded through public auctions, that are concluded between private companies and public authorities and are being settled under the jurisdiction of civil courts, according to Law no. 101/2016, article 53, paragraph 11 ); low value claims, payment disputes, debt recoveries, appeals against enforcement or levy of execution, seizure validations;
company law – establishment of companies (SRL, SRL-D), mentions and modifications of articles of association, drafting resolutions of the General Meeting, assistance and representation in disputes based on Law no. 31/1990 on business entities, assistance and representation in the relationship with the Trade Registry Office;
civil contracts and contracts concluded between professionals (commercial), including those with foreign elements;
family law – proceedings of divorce, partition, establishment of a child’s paternity, establishment/increase of alimony, entrusting minors, protection orders;
property related rights – ownership rights and its dismembered rights (superficies, usufruct, use and occupation, easements);
assisting clients in relation to public notaries for concluding various types of contracts and transactions (elaborating power of attorney documents, consensual divorce proceedings, establishment of visiting schedules for children with divorced parents, establishment of alimony, property purchase agreements and pre-contracts, mortgage agreements, share purchase agreements, rectifying notary issued documents, inheritance and will proceedings, etc);
assisting and representing clients (debtors or creditors) in cases concerning enforcement or levy of execution proceedings.

Other activities in the field of civil law:

establishment of non-governmental organizations – associations, foundations;
registration of political parties and amendments of their by-laws, according to Law no. 14/2003 on political parties;
assistance and representation before the cadastre and Land Registration Offices;
