P\u00e2rghiile pe care le au la dispozi\u021bie angajatorii pentru a-i \u021bine aproape pe salaria\u021bii \u00een a c\u0103ror preg\u0103tire profesional\u0103 au investit sume considerabile de bani.<\/h2>\r\n<p class=\"post-media wp-block-paragraph\"><strong> Articole aplicabile \u2013 art. 197, art. 198 din Legea nr. 53\/2003 privind Codul Muncii<\/strong><\/p>\r\n<p>Conform Codului Muncii, atunci c\u00e2nd ini\u021biativa particip\u0103rii la cursuri de formare profesional\u0103 \u00eei apar\u021bine angajatorului, acesta din urm\u0103 trebuie s\u0103 suporte \u0219i costurile acestor demersuri.<\/p>\r\n<div class=\"post-content the-content\">\r\n<p>A\u0219adar, pentru a fi aplicabile prevederile Codului Muncii \u00een ceea ce prive\u0219te suportarea cheltuielilor ocazionate de pregatirea profesional\u0103 a unei persoane, angajatorul trebuie s\u0103 semneze contractul individual de munc\u0103 cu salariatul \u00eenainte de a-l trimite pe acesta la cursuri. Facem aceast\u0103 precizare \u00eentruc\u00e2t ne-am \u00eent\u00e2lnit cu situa\u021bii \u00een care angajatorii, din dorin\u021ba de a accelera procedurile, au achitat costurile unor cursuri de formare profesional\u0103 anterior semn\u0103rii unui contract individual de munc\u0103 cu persoana beneficiar\u0103 a cursurilor. \u00centr-o asemenea situa\u021bie, inserarea unei clauze de formare profesional\u0103 \u00een contractul de munc\u0103 devine un subiect sensibil, angajatorul neput\u00e2nd face dovada unor cheltuieli suportate cu ocazia execut\u0103rii contractului de munc\u0103, ci anterior \u00eencheierii acestuia.<\/p>\r\n<p>A\u0219adar, pentru a ne \u00eencadra \u00een aria de reglementare prev\u0103zut\u0103 de art. 197 din Codul Muncii, \u00eenainte de a suporta orice fel de costuri de formare profesional\u0103, angajatorul trebuie s\u0103 dea na\u0219tere raportului juridic de munc\u0103 dintre sine \u0219i salariat, prin semnarea unui contract de munc\u0103.<\/p>\r\n<p>Salaria\u021bii care au beneficiat de stagii de preg\u0103tire profesional\u0103 la ini\u021biativa angajatorului \u0219i cu sprijinul financiar al acestuia pot suporta, conform legii, o \u00eengr\u0103dire a dreptului de a solicita \u00eencetarea contractului de munc\u0103 din proprie ini\u021biativ\u0103 (prin demisie). Aceast\u0103 \u00eengr\u0103dire trebuie s\u0103 fac\u0103 obiectul unui act adi\u021bional la contractul de munc\u0103, \u00een cadrul c\u0103ruia se insereaz\u0103 a\u0219a-numita clauz\u0103 de formare profesional\u0103.<br \/>\u00cen privin\u021ba con\u021binutului clauzei de formare profesional\u0103, aceasta trebuie s\u0103 con\u021bin\u0103:<\/p>\r\n<ul>\r\n<li>\r\n<p>interdic\u021bia salariatului de a avea ini\u021biativa \u00eencet\u0103rii contractului de munc\u0103;<\/p>\r\n<\/li>\r\n<li>\r\n<p>durata pentru care se stabile\u0219te interdic\u021bia;<\/p>\r\n<\/li>\r\n<li>\r\n<p>consecin\u021ba nerespect\u0103rii interdic\u021biei.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<p>\u00cen ceea ce prive\u0219te durata pentru care se stabile\u0219te interdic\u021bia, legea nu stabile\u0219te care sunt criteriile \u00een func\u021bie de care angajatorul \u0219i salariatul negociaz\u0103 acest aspect, \u00eens\u0103 \u00een practic\u0103 se are \u00een vedere complexitatea muncii prestate de salariat, durata cursurilor de formare profesional\u0103, costurile cursurilor, importan\u021ba pe care o prezint\u0103 postul ocupat de salariat \u00een cadrul societ\u0103\u021bii angajatorului, intervalul de timp \u00een care angajatorul \u00eel poate \u00eenlocui pe acel salariat cu un altul, f\u0103r\u0103 a-i fi prejudiciat\u0103 activitatea.<\/p>\r\n<p>Conform Codului Muncii, nerespectarea interdic\u021biei de c\u0103tre salariat determin\u0103 obligarea acestuia la suportarea costurilor preg\u0103tirii profesionale, propor\u021bional cu perioada nelucrat\u0103 din durata de valabilitate a interdic\u021biei. A\u0219adar, conform legii, dac\u0103 salariatul alege s\u0103 demisioneze, prin nerespectarea clauzei de formare profesional\u0103, acesta ar putea suporta numai costurile avansate de angajator pentru cursurile urmate, iar nu o sum\u0103 stabilit\u0103 arbitrar de c\u0103tre angajator.<\/p>\r\n<p>Cu toate acestea, \u00een practic\u0103 se admite stabilirea unor desp\u0103gubiri mai mari dec\u00e2t strict costurile preg\u0103tirii profesionale, cu condi\u021bia ca \u0219i angajatorul s\u0103-\u0219i asume prin acela\u0219i act adi\u021bional obliga\u021bia de a nu-l concedia pe salariat \u00een aceea\u0219i perioad\u0103 pentru care salariatul \u00ee\u0219i asum\u0103 obliga\u021bia de a nu demisiona \u0219i sub aceea\u0219i sanc\u021biune. Cu alte cuvinte, cuantumul desp\u0103gubirii poate fi mai mare dec\u00e2t costul form\u0103rii profesionale numai dac\u0103 angajatorul, la r\u00e2ndul s\u0103u, \u00ee\u0219i asum\u0103 obliga\u021bia de a pl\u0103ti aceea\u0219i desp\u0103gubire dac\u0103 ini\u021biativa \u00eencet\u0103rii contractului \u00eei va apar\u021bine.<\/p>\r\n<h3>Obliga\u021bia angajatorului de a nu-l concedia pe salariat subzist\u0103 numai pentru motivele de concediere care nu \u021bin de persoana salariatului, \u0219i anume, desfiin\u021barea postului din organigrama angajatorului.<\/h3>\r\n<p>A\u0219adar, \u00een situa\u021bia \u00een care pe parcursul execut\u0103rii contractului de munc\u0103 se pune problema \u00eencet\u0103rii contractului pentru motive care au leg\u0103tur\u0103 cu salariatul (abateri disciplinare, necorespundere profesional\u0103, inaptitudine fizic\u0103\/psihic\u0103, arest preventiv) angajatorul poate \u00eenceta contractul f\u0103r\u0103 a suporta vreo desp\u0103gubire.<\/p>\r\n<p>\u00cen concluzie, de\u0219i legisla\u021bia de dreptul muncii este restrictiv\u0103 \u00een ceea ce prive\u0219te capacitatea angajatorului de a rest\u00e2nge sau condi\u021biona dreptul salariatului de a \u00eenceta raportul de munc\u0103 din proprie ini\u021biativ\u0103, practica \u0219i jurispruden\u021ba au creat anumite p\u00e2rghii prin care efectul restrictiv al clauzelor de stabilitate este atenuat. \u00cen acest sens, s-a deschis calea asum\u0103rii unor obliga\u021bii reciproce de c\u0103tre p\u0103r\u021bile contractului de munc\u0103, prin care se confer\u0103 un grad sporit de stabilitate raportului de munc\u0103 \u0219i, \u00een acela\u0219i timp, se asigur\u0103 dezvoltarea armonioas\u0103 a capacit\u0103\u021bilor profesionale ale salaria\u021bilor.<\/p>\r\n<p>Credit foto: <a href=\"http:\/\/www.wbrtraining.ro\" target=\"_blank\" rel=\"noopener\">www.wbrtraining.ro<\/a><\/p>\r\n<\/div>\r\n<p><strong><\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Clauza de stabilitate din Contractul Individual de Munc\u0103.
