{"id":1559,"date":"2023-09-12T15:11:22","date_gmt":"2023-09-12T15:11:22","guid":{"rendered":"https:\/\/aad-lawyers.ro\/cateva-cuvinte-despre-amnistie-si-gratiere\/"},"modified":"2023-11-06T15:24:54","modified_gmt":"2023-11-06T15:24:54","slug":"constatarea-si-sanctionarea-abaterilor-disciplinare-savarsite-de-salariati","status":"publish","type":"post","link":"https:\/\/aad-lawyers.ro\/en\/constatarea-si-sanctionarea-abaterilor-disciplinare-savarsite-de-salariati\/","title":{"rendered":"Constatarea \u0219i sanc\u021bionarea abaterilor disciplinare s\u0103v\u00e2r\u0219ite de salaria\u021bi"},"content":{"rendered":"<p><strong>Pa\u0219ii pe care trebuie s\u0103 \u00eei urmeze angajatorul \u00een vederea const\u0103t\u0103rii \u0219i sanc\u021bion\u0103rii abaterilor disciplinare s\u0103v\u00e2r\u0219ite de salaria\u021bi.<\/strong><\/p>\n<p>Legea nr. 53\/2003 privind Codul muncii (\u00een continuare Codul muncii) define\u0219te abaterea disciplinar\u0103 ca fiind o\u00a0<em>fapt\u0103 \u00een leg\u0103tur\u0103 cu munca \u015fi care const\u0103 \u00eentr-o ac\u0163iune sau inac\u0163iune s\u0103v\u00e2r\u015fit\u0103 cu vinov\u0103\u0163ie de c\u0103tre salariat, prin care acesta a \u00eenc\u0103lcat normele legale, regulamentul intern, contractul individual de munc\u0103 sau contractul colectiv de munc\u0103 aplicabil, ordinele \u015fi dispozi\u0163iile legale ale conduc\u0103torilor ierarhici.<\/em><\/p>\n<p>Ori de c\u00e2te ori angajatorul constat\u0103 c\u0103 un salariat a s\u0103v\u00e2r\u0219it o abatere disciplinar\u0103, acesta \u00eel poate sanc\u021biona disciplinar cu una dintre sanc\u021biunile prev\u0103zute de art. 248 alin. 1 Codul muncii. Procedura legal\u0103 de constatare \u0219i sanc\u021bionare a abaterilor disciplinare este una strict\u0103 \u0219i complex\u0103, iar orice nerespectare a acestei proceduri poate fi sanc\u021bionat\u0103 de instan\u021ba de judecat\u0103 competent\u0103 cu anularea deciziei de sanc\u021bionare \u0219i cu obligarea angajatorului s\u0103 acopere eventualele prejudicii suferite de salariat pentru sanc\u021bionarea sa nelegal\u0103.<\/p>\n<p>Conform art. 251 alin. 1 din Codul muncii, nicio sanc\u021biune disciplinar\u0103 (cu excep\u021bia avertismentului) nu poate fi dispus\u0103 f\u0103r\u0103 efectuarea unei cercet\u0103ri disciplinare prealabile.<\/p>\n<p>\u00cen continuare vom face o trecere \u00een revist\u0103 a pa\u0219ilor ce trebuie urma\u021bi \u00een vederea efectu\u0103rii unei cercet\u0103ri disciplinare care s\u0103 respecte exigen\u021bele legii.<\/p>\n<ol>\n<li><strong>\u00cencuno\u0219tin\u021barea conducerii despre s\u0103v\u00e2r\u0219irea abaterii disciplinare<\/strong>.<\/li>\n<\/ol>\n<p>Primul pas pentru a putea demara o procedur\u0103 de cercetare disciplinar\u0103 este ca angajatorul s\u0103 fie informat \u00een mod oficial despre faptele care ar putea constitui o abatere disciplinar\u0103. Sesizarea poate \u00eembr\u0103ca forma unei note informative sau a unui referat \u0219i poate fi semnat\u0103 at\u00e2t de un alt angajat c\u00e2t \u0219i de un ter\u021b care poate justifica un interes legitim.<\/p>\n<p>\u00cen situa\u021bia \u00een care persoana din conducere identific\u0103 personal anumite fapte ce ar putea constitui o abatere disciplinar\u0103, apreciem c\u0103 acest aspect trebuie consemnat \u00eentr-un proces-verbal ce va primi un num\u0103r de \u00eenregistrare \u00een registrul societ\u0103\u021bii.<\/p>\n<ol start=\"2\">\n<li><strong>Conducerea emite o decizie de constituire a comisiei de disciplin\u0103<\/strong>.<\/li>\n<\/ol>\n<p>Dup\u0103 ce a fost legal sesizat, angajatorul va transmite atribu\u021bia de a efectua cercetarea disciplinar\u0103 c\u0103tre o comisie de disciplin\u0103. \u00cen acest sens, se va emite o dezicie de numire a comisiei de disciplin\u0103.<\/p>\n<p>\u00cen privin\u021ba componen\u021bei comisiei de disciplin\u0103, ca regul\u0103, aceasta este stabilit\u0103 prin Regulamentul de ordine interioar\u0103 al societ\u0103\u021bii. \u00cen acest mod, p\u0103r\u021bile contractului de munc\u0103 se asigur\u0103 c\u0103 angajatorul nu va numi \u00een mod arbitrar membrii comisiei, astfel \u00eenc\u00e2t cercetarea disciplinar\u0103 s\u0103 constiuie mai degrab\u0103 o formalitate prealabil\u0103 sanc\u021bion\u0103rii dec\u00e2t o veritabil\u0103 verificare a faptelor s\u0103v\u00e2r\u0219ite de salariat. Astfel, cerin\u021bele de echitate \u0219i impar\u021bialitate se asigur\u0103 prin inserarea \u00een regulamentul de ordine interioar\u0103 a regulii conform c\u0103reia comisia de disciplin\u0103 este format\u0103 din trei membri, dintre care este recomandabil ca cel pu\u021bin unul s\u0103 fie ales dintre reprezentan\u021bii salaria\u021bilor \u00een societate.<\/p>\n<p>Totu\u0219i, subliniem faptul c\u0103 nu exist\u0103 dispozi\u021bii legale care \u00eel oblig\u0103 pe angajator s\u0103 numeasc\u0103 o comisie format\u0103 din trei membri, iar cercetarea disciplinar\u0103 se poate desf\u0103\u0219ura \u0219i dac\u0103 o singur\u0103 persoan\u0103 este \u00eens\u0103rcinat\u0103 cu efectuarea cercet\u0103rii.<\/p>\n<p>Este recomandat ca decizia de numire a membrilor comisie de disciplin\u0103 s\u0103 prevad\u0103 \u0219i c\u00e2te un membru supleant, care s\u0103 asigure \u00eenlocuirea celui care lipse\u0219te de la lucr\u0103rile comisiei.<\/p>\n<p><strong>Din momentul \u00een care se emite decizia de numire a comisiei \u0219i se comunic\u0103 celor implica\u021bi, conducerea angajatorului nu mai are nicio implicare \u00een cercetarea disciplinar\u0103 (p\u00e2n\u0103 \u00een momentul \u00een care prime\u0219te raportul comisiei \u0219i trebuie s\u0103 dea o decizie de sanc\u021bionare).<\/strong><\/p>\n<ol start=\"3\">\n<li><strong>Convocarea salariatului la cercetarea disciplinar\u0103 prealabil\u0103.<\/strong><\/li>\n<\/ol>\n<p><strong>Comisia de disciplin\u0103 va convoca \u00een scris salariatul<\/strong>\u00a0pentru a participa la cercetarea disciplinar\u0103, preciz\u00e2nd urm\u0103toarele elemente: obiectul cercet\u0103rii (se va men\u021biona abaterea\/abaterile disciplinar\u0103\/e care fac obiectul cercet\u0103rii), data la care va avea loc (convocarea scris\u0103 trebuie s\u0103-i fie comunicat\u0103 salariatului cu suficient timp \u00eenainte de \u0219edin\u021b\u0103, astfel \u00eenc\u00e2t acesta s\u0103 aib\u0103 timp s\u0103-\u0219i preg\u0103teasc\u0103 ap\u0103rarea), ora \u0219i locul unde va avea loc cercetarea disciplinar\u0103.<\/p>\n<p>\u00cen ceea ce prive\u0219te modalitatea de comunicare a convoc\u0103rii, aceasta se poate face\u00a0<strong>direct, prin \u00eenm\u00e2narea unui exemplar salariatului<\/strong>\u00a0\u0219i semnarea de primire, cu men\u021biunea c\u0103 pe exemplarul ce va r\u0103m\u00e2ne la angajator trebuie s\u0103 se indice \u0219i data comunic\u0103rii convoc\u0103rii, sau\u00a0<strong>prin po\u0219t\u0103, prin scrisoare cu confirmare de primire \u0219i con\u021binut declarat.<\/strong><\/p>\n<ol start=\"4\">\n<li><strong>Preg\u0103tirea \u0219edin\u021bei de cercetare disciplinar\u0103.<\/strong><\/li>\n<\/ol>\n<p>Comisiei de disciplin\u0103 i se va pune la dispozi\u021bie dosarul salariatului a c\u0103rui cercetare disciplinar\u0103 se face, sens \u00een care se va \u00eencheia un proces verbal \u00eentre membrii comisiei \u0219i salariatul din cadrul departamentului de resurse umane care pred\u0103 dosarul.<\/p>\n<p>De asemenea, comisia de disciplin\u0103 poate face \u0219i alte demersuri \u00een vederea clarific\u0103rii aspectelor semnalate \u00een sesizarea ini\u021bial\u0103, cu men\u021biunea c\u0103 toate acestea \u00eei vor fi prezentate salariatului vizat astfel \u00eenc\u00e2t acesta s\u0103-\u0219i poat\u0103 face ap\u0103rarea.<\/p>\n<ol start=\"5\">\n<li><strong>Modalitatea \u00een care se deruleaz\u0103 \u0219edin\u021ba de cercetare disciplinar\u0103, dup\u0103 cum salariatul se prezint\u0103 sau nu la data la care a fost convocat.<\/strong><\/li>\n<\/ol>\n<p><strong>\u00cen situa\u021bia \u00een care salariatul nu se prezint\u0103, \u00a0<\/strong>angajatorul este \u00eendrept\u0103\u021bit s\u0103-l sanc\u021bioneze disciplinar f\u0103r\u0103 a mai desf\u0103\u0219ura cercetarea disciplinar\u0103 prealabil\u0103. La data la care salariatul era convocat, membrii comisiei de disciplin\u0103 vor \u00eentocmi un proces verbal\u00a0 prin care vor ar\u0103ta c\u0103 salariatul a fost convocat, dar nu s-a prezentat.<\/p>\n<p><strong>\u00cen situa\u021bia \u00een care salariatul se prezint\u0103,\u00a0<\/strong>va avea loc cercetarea disciplinar\u0103 propriu-zis\u0103. Astfel, comisia de disciplin\u0103 \u00eei va prezenta salariatului faptele cu care a fost sesizat angajatorul \u0219i \u00eei va da posibilitatea s\u0103-\u0219i sus\u021bin\u0103 punctul de vedere.<\/p>\n<p>\u00cen cadrul cercet\u0103rii disciplinare, salariatul beneficiaz\u0103 de urm\u0103toarele drepturi:<\/p>\n<ol>\n<li>S\u0103 fie ascultat<strong>;<\/strong><\/li>\n<li>S\u0103 formuleze \u0219i s\u0103 sus\u021bin\u0103 toate ap\u0103r\u0103rile;<\/li>\n<li>S\u0103 aduc\u0103 probe. \u00cen cazul \u00een care nu poate prezenta probele la prima \u0219edin\u021b\u0103, se poate fixa o \u0219edin\u021b\u0103 suplimentar\u0103;<\/li>\n<li>S\u0103 fie asistat de un reprezentant al sindicatului din care face parte sau de un avocat.<\/li>\n<li><strong>\u00centocmirea procesului verbal de cercetare disciplinar\u0103<\/strong><\/li>\n<\/ol>\n<p><strong>\u00cen urma cercet\u0103rii, comisia de disciplin\u0103 va \u00eentocmi un proces verbal care trebuie s\u0103 cuprind\u0103 urm\u0103toarele elemente obligatorii:<\/strong><\/p>\n<ul>\n<li>descrierea faptei ce face obiectul sesiz\u0103rii, a \u00eemprejur\u0103rilor \u00een care s-a s\u0103v\u00e2r\u0219it, a urm\u0103rilor avute (eventuale prejudicii aduse imaginii angajatorului, tulbur\u0103ri interne, conflicte \u00eentre angaja\u021bi). \u00cen cadrul descrierii faptei trebuie men\u021bionate toate considerentele care ar putea duce la aplicarea sanc\u021biunii disciplinare. Dac\u0103 decizia de sanc\u021bionare va fi atacat\u0103 la instan\u021ba competent\u0103, angajatorul nu va putea invoca niciun alt motiv pentru sanc\u021bionare \u00een afar\u0103 de cele pentru care s-a efectuat cercetarea disciplinar\u0103.<\/li>\n<li>Precizarea prevederilor \u00eenc\u0103lcate de salariat din Regulamentul de Ordine Interioar\u0103, CIM, fi\u0219a postului, Codul Muncii sau precizarea dispozi\u021biilor\/ordinelor angajatorului care nu au fost urmate.<\/li>\n<li>Precizarea faptului c\u0103 salariatul a fost ascultat.<\/li>\n<li>Ap\u0103r\u0103rile formulate de salariat \u00een timpul cercet\u0103rii disciplinare \u0219i motivele pentru care sunt \u00eenl\u0103turate\/acceptate aceste ap\u0103r\u0103ri.<\/li>\n<li>Dac\u0103 este cazul, propunerea unei sanc\u021biuni disciplinare, prin raportare la urm\u0103toarele criterii:<\/li>\n<\/ul>\n<ol>\n<li>\u00cemprejur\u0103rile s\u0103v\u00e2r\u0219irii faptei;<\/li>\n<li>Gradul de vinov\u0103\u021bie;<\/li>\n<li>Consecin\u021bele abaterii;<\/li>\n<li>Comportarea \u00een serviciu \u0219i eventualele sanc\u021biuni disciplinare avute anterior (a\u0219a cum reies din dosarul salariatului).<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"7\">\n<li><strong>\u00cenregistrarea procesului verbal de cercetare disciplinar\u0103.<\/strong><\/li>\n<\/ol>\n<p>Procesul verbal \u00eenregistrat se \u00eenm\u00e2neaz\u0103 persoanei din conducerea angajatorului, \u00eempreun\u0103 cu dosarul cercet\u0103rii disciplinare. Dac\u0103 membrii comisiei de cercetare disciplinar\u0103 ajung la concluzia c\u0103 salariatul a s\u0103v\u00e2r\u0219it o abatere disciplinar\u0103, data \u00eenregistr\u0103rii procesului verbal \u00een cadrul societ\u0103\u021bii va fi considerat\u0103 \u0219i data de la care angajatorul a luat cuno\u0219tin\u021b\u0103 despre s\u0103v\u00e2r\u0219irea abaterii disciplinare.<\/p>\n<p>A\u0219adar, termenul de 30 de zile prev\u0103zut de Codul muncii \u00een care angajatorul trebuie s\u0103 aplice sanc\u021biunea disciplinar\u0103 curge de la data la care comisia disciplinar\u0103, \u00een urma cercet\u0103rii, stabile\u0219te c\u0103 salariatul a s\u0103v\u0103r\u0219it o abatere disciplinar\u0103, iar nu de la data la care angajatorul a primit sesizarea ini\u021bial\u0103 cu privire la s\u0103v\u00e2r\u0219irea unei fapte ce ar putea constitui abatere disciplinar\u0103.<\/p>\n<p>\u00cen baza procesului verbal de cercetare disciplinar\u0103 \u0219i a dosarului ce cuprinde lucr\u0103rile comisiei de disciplin\u0103, angajatorul va aplica o\u00a0<strong>sanc\u021biune disciplinar\u0103, prin decizie motivat\u0103,<\/strong>\u00a0\u00een maxim 30 de zile de la \u00eenregistrarea procesului verbal \u0219i cu respectarea unui termen de cel mult 6 luni de la s\u0103v\u00e2r\u0219irea faptei ce constituie abatere disciplinar\u0103.<\/p>\n<ol start=\"8\">\n<li><strong>Comunicarea deciziei de sanc\u021bionare disciplinar\u0103.<\/strong><\/li>\n<\/ol>\n<p>Decizia de sanc\u021bionare se comunic\u0103 salariatului \u00een 5 zile calendaristice de la emitere.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Pentru a veni \u00een sprijinul celor interesa\u021bi, anex\u0103m prezentului articol\u00a0<strong>un model de decizie de numire a comisiei disciplinare<\/strong>\u00a0\u0219i\u00a0<strong>un model de convocare a salariatului la cercetarea disciplinar\u0103<\/strong>, redactate de avoca\u021bii AAD Lawyers \u00een conformitate cu dispozi\u021biile legale aplicabile la data public\u0103rii articolului.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>credit foto:\u00a0<a href=\"http:\/\/www.huffpost.com\" target=\"_blank\" rel=\"noopener\">www.huffpost.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pa\u0219ii pe care trebuie s\u0103 \u00eei urmeze angajatorul \u00een vederea const\u0103t\u0103rii \u0219i sanc\u021bion\u0103rii abaterilor disciplinare s\u0103v\u00e2r\u0219ite de salaria\u021bi.
