CRIMINAL LAW

We conduct our activity in cases regarding the following offences:

  • offences against property: fraud, embezzlement, theft, breach of trust, misappropriation of public tenders, computer fraud, destruction, disturbance of possession;
  • offences against the realisation of justice: non-compliance with court judgements, favouring the offender, perjury;
  • corruption and office-related offences: bribe taking, bribe giving, influence peddling, influence buying, abuse and negligence of office, conflict of interests, illegally obtaining funds;
  • forgery;
  • offences against safety on public roads: putting into circulation or driving an unregistered vehicle; driving under the influence of alcohol or other substances, driving without holding a driving license, leaving the place of the accident;
  • offences against public order: establishing an organized criminal group, disturbance of public order;
  • offences against family: family abandonment;
  • offences of genocide, against humanity and war genocide;
  • offences from special laws – the facts incriminated by Law no. 241/2005 on the prevention and fight against tax evasion, Law no. 78/2000 on the prevention, discovery and sanctioning of corruption deeds, Law no. 656/2002 for the prevention and sanctioning of money laundering;

We offer assistance and representation to our clients in all the three stages of a criminal trial:

1. Criminal prosecution stage:

  • preparation of a strategy corresponding to the clients’ interests – suspects, defendants, civil party, party liable under civil law;
  • submitting complaints, requests, memoranda, exceptions and objections to the criminal prosecution bodies;
  • assisting clients upon performance of criminal prosecution deeds – hearing and submitting other evidence;
  • assisting and filing requests in respect of taking, replacing, maintaining, revoking of preventive measures – holding in custody, judicial control, domicile arrest and preventive arrest;
  • appeal against preventative measures – seizure, garnishment;
  • drawing up criminal complaints, suing as civil party in the criminal lawsuit;

2. Judgement stage:

  • drawing up requests and exceptions forming the object of the preliminary chamber procedure;
  • appeal against the court reports issued by the preliminary chamber judge;
  • assisting the defendants, parties liable under civil law or civil parties throughout the entire criminal lawsuit, until the issuance of a final ruling;

3. Stage of enforcement of criminal decisions:

  • assisting the persons sentenced to penalties with service suspension;
  • drawing up and supporting appeals against enforcement;
  • drawing up requests, memoranda and petitions to the detention facilities;
  • assisting sentenced persons within the conditional release and rehabilitation procedure;

CIVIL LAW

Our activity includes consultancy and representation to clients in courts or before the public or private institutions in the following sectors of the civil law:

  • company law – establishment of companies (SRL, SRL-D), mentions and modifications of articles of association, drafting resolutions of the General Meeting, assistance and representation in disputes based on Law no. 31/1990 on business entities, assistance and representation in the relationship with the Trade Registry Office;
  • civil contracts and contracts concluded between professionals (commercial), including those with foreign elements;
  • family law – proceedings of divorce, partition, establishment of a child’s paternity, establishment of alimony, entrusting minors, protection orders;
  • intellectual property right – copyrights and related rights;
  • property related rights – ownership rights and its dismembered rights (superficies, usufruct, use and occupation, easements);

Other activities in the field of civil law:

  • establishment of non-governmental organizations – associations, foundations;
  • registration of political parties and amendments of their by-laws, according to Law no. 14/2003 on political parties;
  • assistance and representation before the cadastre and Land Registration Offices;

ADMINISTRATIVE LAW

We offer our clients consultancy and representation before the courts of law, the arbitration tribunals, as well as before the public authorities, in the following fields:

  • assisting clients in going through the public procurement and concession procedures, based on Government Emergency Ordinance no. 34/2006 on the award of public procurement contracts, of the public works concession contracts and of the services concession contracts, Government Emergency Ordinance no. 54/2006 on the regime of public property goods concession contracts;
  • consultancy on the conclusion, performance and termination of the agreements containing FIDIC contractual conditions (International Federation of Consulting Engineers);
  • assistance and representation in relation to the procedure for establishment and sanctioning of irregularities occurred in obtaining and using European funds and/or national public funds related thereto according to Government Emergency Ordinance no. 66/2011 – submitting requests for suspension of execution, filing appeals against minutes establishing the irregularities and establishing the budgetary receivables resulting from irregularities, filing requests to cancel the minutes establishing the irregularities and establishing the budgetary receivables resulting from irregularities;
  • assistance and representation upon issuance of the inspection reports by the Fight against fraud department (DLAF);
  • assistance and representation upon preparation of the assessment reports by the National Integrity Agency (ANI), as well as within the procedure for verification of the estate assessment reports by the Investigation Committees (operating attached to the Courts of Appeal) and filing appeals against the reports before the administrative dispute courts;
  • filing requests based on Law no. 554/2004 on administrative disputes;

LABOUR LAW

We provide legal services both to employers and to employees, on the following aspects of work relationships:

  • assistance and representation within labour disputes – unlawful dismissal, appeal against other disciplinary sanctions, disputes arising from labour accidents;
  • entailing patrimonial liability within labour relationships;
  • assistance and legal coordination of the human resources departments of the public or private law legal entities;

LAW ON MISDEMEANOURS

We prepare legal opinions and assist our clients in relation to all legal relationships entailing contraventional liability, for instance:

  • traffic misdemeanours, provided by Government Emergency Ordinance no. 195/2002 on traffic on public roads and Government Ordinance 15/2002 on the enforcement of the fee for using and passing on the Romanian national roads network;
  • misdemeanours in the field of environment protection;
  • misdemeanours provided by Government Ordinance no. 21/1992 on consumers’ protection;

HUMAN RIGHTS EUROPEAN LAW

We offer legal assistance in drawing up requests grounded on the European Convention on Human Rights (ECHR).
